Version 2026-09 · Beta draft

Peer-to-peer rental agreement

This working draft supports product testing. It is not a substitute for legal advice and should receive attorney review before paid rentals launch.

1. The parties

The item owner and renter contract directly with each other. Mine2Yours provides marketplace tools and records but is not the owner, renter, insurer, guarantor, or repair provider.

2. Item and rental period

The listing, approved dates, price, deposit, included accessories, pickup location, and condition reports form part of this agreement.

3. Owner promises

The owner confirms that the item is lawfully owned, accurately described, reasonably safe for the disclosed use, and may legally be rented. The owner must disclose known defects and provide agreed accessories.

4. Renter promises

The renter will use the item lawfully and only as intended, follow safety instructions, prevent unauthorized use, avoid alterations, and return the item on time in substantially the same condition except ordinary wear.

5. Inspection and handoff

Both parties may inspect and photograph the item at pickup and return. A submitted condition report does not prevent either party from reporting a hidden issue discovered later.

6. Charges, deposits, and fees

Once payments are enabled, renters pay the displayed rental price plus a 10% Mine2Yours service fee. Mine2Yours deducts a 3% owner transaction fee from the rental price before the owner payout. A refundable deposit is separate, is not platform revenue, and should be placed as a temporary card authorization whenever supported. A deposit is not an automatic damage payment; any deduction should be supported by evidence and an itemized amount.

7. Cancellation and no-show

The cancellation policy selected on the listing and shown before the rental request controls eligible refunds. Stripe processing and Connect costs may not be returned to Mine2Yours after a refund, and any nonrefundable amount must be disclosed before paid rentals launch. A documented no-show may be treated as a late cancellation. Neither party should arrange off-platform payment to avoid applicable fees or protections.

8. Damage, loss, and late return

The renter may be responsible for reasonable documented repair cost, fair replacement value, missing accessories, and applicable late charges caused during the rental, excluding pre-existing damage and ordinary wear.

9. Incidents and disputes

Safety incidents should be addressed immediately and, when appropriate, reported to emergency services or law enforcement. Platform disputes require timely descriptions, condition records, messages, receipts, and other available evidence.

10. No insurance promise

Unless a specific protection plan is shown in writing for the rental, neither party should assume Mine2Yours provides insurance. Owners and renters are responsible for confirming their own coverage.

11. Electronic acceptance

Selecting “Accept agreement” records the user, rental request, role, agreement version, and acceptance time. Each party should retain a copy of the agreement and rental record.

12. Governing terms

Applicable law and any final dispute-resolution process will be stated in the production Terms of Service. Rights that cannot legally be waived remain unaffected.
